Terms
About these terms
Proactive Parent is provided by Right Stack Ltd, 86–90 Paul Street, London, EC2A 4NE, United Kingdom (“we”, “us”).
On an iPhone, the app is licensed to you under Apple’s Licensed Application End User License Agreement (the standard EULA). On an Android phone, you get the app from Google Play, and these terms are your licence to use it, for your own personal use. These terms add what is particular to Proactive Parent: what the service is, how a family works, what Proactive Plus costs, and what we each take responsibility for. They apply when you use the app, alongside Apple’s or Google’s terms; where they differ, these terms apply between you and us, to the extent the law allows. How we handle your data is explained in our privacy policy.
Information, not medical advice
Proactive Parent helps you keep track of a pregnancy and a young child, shows what is coming up for your stage, and reminds you. It is not a medical service and it is not medical advice.
- Where an official source exists, the guidance in the app is taken from it — for families in the UK, the NHS website — and each such item says where it comes from.
- Where there is no official source, or it is too thin to be useful, we write the guidance ourselves — for example the week-by-week cards about a baby’s first year. Each of these says “Written by Proactive Parent”. It is general information, drawn from what public health services and widely used parenting guides say; it is not medical advice, it gives no doses, it never names what might be wrong, and for anything about your or your child’s health it sends you to your midwife, health visitor or doctor. It is never presented as coming from the NHS or any other publisher.
- None of the app’s content, whether taken from a source or written by us, has been checked by clinicians of our own.
- The NHS and the other sources we draw on are not connected with Proactive Parent and have not approved it.
- Guidance follows the country where you are cared for, which you choose in the app. We do not have guidance for every country or every stage yet — we do not yet have guidance for Turkey — and where we have none, the app shows none rather than another country’s.
- Nothing in the app, and nothing Daphne says, replaces your midwife, health visitor, doctor or nurse. If you are worried about yourself or your child, contact them.
- Reminders depend on your phone’s settings, its connection and the guidance available for your region. Do not rely on the app alone to remember an appointment.
In an emergency
If you think you or your child needs urgent help, call your local emergency number now — 999 in the UK, 911 in the US, 112 in Turkey. Do not wait for the app, and do not use our support email: it is not watched around the clock and cannot help in an emergency.
Using the app
- The app is for parents, people expecting a baby, and the adults who help care for a child. You must be 18 or over to use it.
- Before the app stores any of your pregnancy or baby details, it asks for your consent to handle health data. Without that consent it cannot be used.
- You can use the app as a guest, without an account. A guest account can be opened only from the phone it was made on: if you lose that phone, or the guest account expires, we cannot recover its records for you. Signing in with Apple or Google keeps your records safe in your account and lets you use more than one phone.
- Keep your phone and your Apple or Google account secure. Anyone who can open the app on your phone can see what you can see in it.
Your family
You can share your family with others — a partner, a grandparent, a nanny — by sending them an invitation link. Joining a family needs an account. A family can have up to 4 people, of any role, with or without Proactive Plus.
- The owner decides who is in the family, the role each person has, and which children a caregiver or viewer is given. If you are the owner, invite only people you trust with your children’s records, and remove anyone who should no longer see them.
- Parents see and log for every child. Caregivers see, and may log for, only the children they were given; viewers can only look.
- Records about the pregnancy itself are seen only by the person who added the pregnancy to the app (the app treats them as the person who is pregnant) and the people they choose to share them with.
- Every member is responsible for what they record. Records are shared: what you log for a child, everyone in the family who can see that child sees too, with your name.
- Add only children you are responsible for, and only invite people with their agreement.
- When someone is removed, their phone deletes the family’s records the next time it connects; until then, what is already on that phone stays there.
Daphne
Daphne is the app’s assistant (Defne in Turkish). You can talk or write to her, and she does what you could do by tapping: logging and correcting records, starting a timer, changing family settings, creating invitations, recording a birth or a loss, and answering questions about what has been recorded.
- She records; she does not advise. She will not tell you whether something is normal, enough or worrying.
- She can mishear a time, an amount or a name. Check what she logs — every record she makes is marked as hers, and you can correct it by tapping it or by telling her.
- Before she does something that is hard to undo, such as recording a birth or a loss or deleting a record, she asks you to say yes first.
- What you say or type to her is processed by OpenAI, and you are asked for your separate consent before your first conversation. See our privacy policy.
- Spoken conversations have a monthly time allowance — 10 minutes for each person, or 300 shared by the whole family with Proactive Plus — which the app shows you as you near the end of it. Writing to her uses none of it. Everything Daphne does can also be done by hand.
Acceptable use
Please do not:
- use the app to record or share information about anyone without the right to do so;
- use an invitation to join a family you were not meant to join, or pass one on;
- try to reach records, accounts or parts of our systems you have not been given, or test our security without our permission;
- interfere with the service, overload it, or use automated means to access it, other than the app itself;
- copy, resell or re-publish the app’s content except as its source’s licence allows;
- use Daphne to produce anything unlawful or abusive.
If you find a security problem, please tell us at support@proactiveparent.app.
Your records
What you record belongs to you. You let us store, sync and process it only to provide the service to you and your family, as the privacy policy describes. You can download it, or delete your account and everything in it, from the app at any time: Family → Your account and data.
Proactive Plus
Proactive Parent is free to use. Proactive Plus is an optional subscription, bought in the app, that adds:
- 300 voice minutes a month with Daphne for the whole family, instead of 10 for each person;
- sleep education: how sleep changes as your baby grows;
- when your baby’s next sleep is likely, from their age and their last wake.
Writing to Daphne, downloading your data and deleting your account are free, with or without Plus, and always will be.
Plans and prices
- There are two plans, monthly and yearly: $9.99 a month or $59.99 a year in the US, £8.99 a month or £54.99 a year in the UK, and ₺249.99 a month or ₺1,499.99 a year in Turkey. In other countries Apple or Google sets the price in your currency. The price follows your App Store or Google Play country, not the region your guidance comes from. The app shows the price, the length of the plan and how it renews before you buy, and Apple or Google shows them again before you confirm.
- The free week. If you have never subscribed to Plus, your first subscription starts with one week free — once per Apple ID or Google account, whichever plan you choose. Unless you cancel before the week ends, the subscription then starts and you are charged the plan’s price.
- It renews automatically. Your subscription renews at the end of each month or year, and the plan’s price is charged to your Apple or Google account, until you cancel. To be sure the next renewal is not charged — or that a free week does not turn into a paid subscription — cancel at least 24 hours before the current period ends. If the price changes, Apple or Google tells you before the new price applies to you.
- How to cancel. Cancel in your store’s subscription settings: on an iPhone, in the Settings app under your name, then Subscriptions; on an Android phone, in the Google Play Store under Payments & subscriptions. The app takes you there too: Family → Proactive Plus → Manage subscription. Deleting the app, or your account, does not cancel a subscription. When you cancel, Plus stays until the end of the period you have paid for, then ends.
- Refunds. Apple or Google takes the payment, under their own terms, and decides on refunds: we cannot refund a purchase made through the App Store or Google Play. Ask Apple or Google for a refund. If one is given, Plus ends.
- Your right to cancel by law. If you live in the UK, the EU or Turkey, consumer law may give you a right to withdraw from a purchase made at a distance. For a subscription bought through the App Store or Google Play, that right is exercised with Apple or Google, under their terms. Nothing here takes away a right you have under consumer law.
One subscription for the family
- Buying or restoring Plus needs an account: Plus covers your whole family, across people and phones, so if you are using the app as a guest you are asked to sign in with Apple or Google first.
- While the person who pays is a member of your family, everyone in it — up to 4 people — has Plus. It is shared through your family in the app, not through Apple’s Family Sharing. Everyone sees that the family has Plus and who pays for it; only the person who pays can manage or cancel it.
- If two members subscribe, each is charged; the app tells the second that the family needs only one subscription, and they can cancel theirs.
- Plus goes with the person who pays. If they leave the family, are removed from it, or delete their account, the family no longer has Plus through them — and their subscription carries on, and is charged, until they cancel it.
- If a renewal payment fails, Apple or Google may keep Plus going for a short time while they try again, and the app tells the person who pays.
- When Plus ends, the voice allowance goes back to 10 minutes a month for each person and the other Plus features stop. Nothing you have recorded is lost.
Discount codes
- We may offer discount codes from time to time. A code is an offer from Apple or Google: entering it in the app takes you to the App Store’s or Google Play’s own redemption, or to buying the offer it names, at the price the store shows you and under the store’s terms. Apple or Google takes the payment and decides on refunds, as for any subscription. We never unlock Plus with a code ourselves.
- Using a code needs an account, as buying does. A code may work on one kind of phone and not the other; the app tells you if it is not available on yours.
- Each code runs between set dates, and outside them it is not valid. We may end or withdraw a code at any time; an offer you have already redeemed or bought carries on under the store’s terms.
- An offer can be used once per person, under the store’s rules. Some offers are only for people who have never had Plus, or whose Plus has ended, and the store decides whether you can use one. An offer takes the place of the free week; it is not added to it.
- A discount applies only to the period the offer states — for example the first year, or the first few months — and free time lasts only as long as the offer says. After that your subscription renews automatically at the plan’s normal price, charged by Apple or Google, until you cancel; to avoid that, cancel at least 24 hours before the offer period ends.
Complimentary Plus
- We may give Plus free of charge to an account of our choosing — for example to an app store’s reviewers, a partner or the press — for a set time or with no end date. It is given at our discretion; no one is entitled to it. It can be given only to a signed-in account, not a guest.
- It covers your family as a subscription does, while the person it was given to is a member. It does not renew, is never billed, and there is nothing to cancel in the App Store or Google Play.
- It ends on its end date, if it has one, and we may end it at any time. When it ends, the family keeps Plus only if a member subscribes; nothing you have recorded is lost.
- It has no cash value, cannot be exchanged for money or for a subscription, and cannot be transferred to another person or account.
Availability and changes
We work to keep the service available, but it may sometimes be interrupted — for maintenance, or because something fails. The app keeps working without a connection for most things, and syncs when it can.
We will change the app over time, and add or update guidance as its sources change. We may change or remove features for security, legal, source-content or service reasons, and we will give advance notice of material changes where reasonably possible. If we change these terms in a way that matters to you, we will publish the new version here with its date and, where appropriate, tell you in the app. If you do not agree to a change, you can stop using the app and delete your account.
Ending
You can stop using Proactive Parent at any time, and delete your account and data from the app. We may suspend or close an account that breaks these terms in a serious way, or to protect other families or the service; where we can, we will tell you why first. If we plan to close the service, we will give you reasonable notice and an opportunity to download your data.
Our responsibility to you
We provide the app with reasonable care and skill. If we fail to, and you suffer loss that was a foreseeable result of our failure, we are responsible for it. We are not responsible for loss that was not foreseeable, for loss caused by events outside our reasonable control, or for business losses — the app is for personal use.
The app provides information, not medical advice. Ask a health professional for decisions about care. This does not limit any responsibility we have under consumer law.
Nothing in these terms limits our liability where the law does not allow it to be limited — including for death or personal injury caused by our negligence, for loss we cause deliberately or through gross negligence, or for fraud — or takes away your rights as a consumer.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you live elsewhere — in Scotland, Northern Ireland, the EU or Turkey, for example — you keep the protection of the mandatory consumer laws of the place where you live, and you can bring a claim in your local courts. If you live in Turkey, you can also apply to the consumer arbitration committee (tüketici hakem heyeti) or the consumer court where you live, within their monetary limits.
